By accessing, browsing, or using the GoNextFleet/Mobility platform ("Platform"), including our website, API services, and related fleet solutions, you ("User," "you," or 'your') acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms govern the use of our services, products, and all your interactions with GoNextFleet/Mobility, and outline the scope and purpose of our fleet management and mobility services.

If you do not agree with these Terms, you must immediately discontinue use of the Platform. These Terms apply to all users, including but not limited to fleet managers, drivers, administrators, and third-party integrators

GoNextFleet/Mobility reserves the right to modify, update, or revise these Terms at any time to reflect changes in our services, legal requirements, or industry standards. These requirements typically include: User privacy: Complying with laws such as the CCPA, GDPR, CalOPPA, and other applicable regulations.

We will notify you of significant changes via the Platform, email notifications, or other reasonable means. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms. The document must be current, definitive, visible, and easily understandable with all applicable regulations.

3. PLATFORM USE AND RESTRICTIONS

3.1 Permitted Use You may use the Platform solely for legitimate fleet management, mobility services, and related business purposes in accordance with these Terms and applicable law. You are responsible for complying with all local, national, and international laws and regulations.

3.2 Prohibited Activities You agree not to:

  • Use the Platform to damage, disable, overburden, or impair our servers or networks

  • Attempt unauthorized access to any part of the Platform, user accounts, or connected systems

  • Deploy automated tools (robots, spiders, scrapers) without explicit written permission

  • Interfere with the security features or proper functioning of the Platform

  • Upload or transmit malicious code, viruses, or harmful content

  • Violate any applicable privacy, data protection, or transportation regulations

4. ARTIFICIAL INTELLIGENCE AND DATA PROCESSING

4.1 AI-Powered Services Our platform uses artificial intelligence for fleet safety monitoring, predictive maintenance, driver behavior analysis, and real-time compliance information. By using our services, you consent to the processing of your fleet data using artificial intelligence for these purposes.

4.2 Data Privacy and Security We implement advanced data anonymization techniques to protect your information and comply with ISO 27001 and NIST 800-53 standards. We ensure compliance with GDPR and local data protection laws, establish access controls, and prioritize cybersecurity.

4.3 Telematics and Vehicle Data Our platform processes telematics data, GPS tracking information, and vehicle performance metrics. This data is used to provide fleet management services, security monitoring, and compliance reporting as outlined in our Privacy Policy.

5. COMPLIANCE AND REGULATORY REQUIREMENTS

5.1 Transportation Compliance Fleet managers must comply with tachograph regulations, CO₂ emissions reporting, and ESG disclosure requirements. Our platform assists with compliance monitoring but does not guarantee regulatory compliance.

5.2 Environmental and Sustainability Reporting We support carbon emissions tracking, sustainability performance metrics, environmental impact assessments, and supply chain transparency to meet new regulatory requirements.

6. INTELLECTUAL PROPERTY RIGHTS

All content, software, algorithms, trademarks, and intellectual property rights on the Platform belong to GoNextFleet/Mobility or our licensors and are protected by international copyright, patent, and trademark laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.

7. USER-GENERATED CONTENT AND DATA

By submitting content, data, or information to the platform, you grant GoNextFleet/Mobility a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze such content for the purposes of service delivery, improvement, and compliance. You retain ownership of your data and may request its deletion in accordance with applicable data protection laws.

8. SERVICE AVAILABILITY AND DISCLAIMERS

8.1 Service Availability Although we strive for continuous service availability, we do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. Scheduled maintenance and updates may temporarily affect the availability of the service.

8.2 Warranty Disclaimer The Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, GoNextFleet/Mobility shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Platform.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless GoNextFleet/Mobility and its affiliates from and against any and all claims, damages, losses, or expenses arising out of your use of the Platform, any breach of these Terms, or any infringement of third-party rights.

11. TERMINATION

Either party may terminate access to the Platform at any time, with or without cause. Upon termination, your right to use the Platform will immediately cease, but certain provisions of these Terms will survive termination.
